In a case that was recently heard by Livingston Sheriff Court, a forklift truck driver who had given fake papers to secure his job was found guilty of violating Section 7 of the Health and Safety at Work etc Act 1974. He was fined 500 pounds after he pleaded guilty to the charge.
Damon Alex McLachlan was working at a house construction site in Livingston, West Lothian. It had only been a few weeks that he had been assigned the task of operating the telehandling machine. The accident occurred on October 10, 2007, when McLachlan was in the midst of unloading a part of wooden house kit using the machine and was placing it on the ground where it was needed for joiners to erect.
While operating the machine, McLachlan failed to deploy the stabilizers, due to which the machine threw off the nearly three-tonne load, crushing and seriously injuring a banksman. Investigations into the accident revealed that McLachlan had supplied partly false evidence about his qualification and experience in order to secure the job.
Following the case, the Health and Safety Executive (HSE) has urged businesses to cross check the qualification and experience documents provided by employees. HSE Inspector Bruce Monaghan said this accident was entirely predictable as the driver had failed to deploy the stabilizers even though the banksman was standing quite close to it. He stressed that workers should meticulously follow the standard operating procedures for the machines, otherwise such tragic incidents were sure to reoccur.
Monaghan further said that this is also a warning for employers and the users of forklift trucks that they should check the qualification and experience proofs of their employees very thoroughly. He pointed out that documents submitted as proofs of qualification, experience and competence can be faked by providing false information, hence businesses must make sure that they perform an out-and-out check on such credentials.

Health and Safety Executive (HSE) will introduce revised guidance for asbestos surveys in the coming autumn. These new guidelines will cover survey, sampling and assessment of materials that contain asbestos.
The revised guidelines will impose many duties on the relevant parties. They will first affect the asbestos surveyors and those who have the responsibility of protecting others from exposure to asbestos. These people who have the duty of planning and carrying out asbestos surveys are called duty holders. They have to collect and provide data regarding the building which has to be inspected, the purpose for which the building is being used and the existing dangers of asbestos in the building.
They have to also ensure that the survey is carried out by qualified surveyors. Thus, to ensure quality standards they should ask the surveyors for the survey plan, insurance policy and work reference.
